Wilsons Competitions LTD – Competition Terms & Conditions

The following terms apply to all the competitions advertised on our website:

The promoter of all the competitions on the site (www.wilsoncompetitions.co.uk) is Wilsons Competitions LTD of 175 Henrietta Street, Girvan, KA26 0AE with registered company number 733917 (“Wilsons Competitions LTD, we, our, us]”).

The competition
We run various skill-based competitions on our website from time to time. The details of each competition is as described on the applicable page of this website.
How to enter
1. The competition will run until the time and date as stated on the applicable competition page (the “Closing Date“).
2. All competition entries must be received by us by no later than the Closing Date. All competition entries received after the Closing Date are automatically disqualified.
3. To enter the competition, you may either:
  1. enter the competition online by creating an online account, answering correctly the competition question, paying the advertised entry fee and submitting the entry via the applicable competition page by the Closing Date; or
  2. use our free entry route by sending a clearly written postcard entry with: (1) details of the competition you wish to enter; (2) the correct answer to the competition question for that particular competition; and (3) details of your name, address and e-mail contact details, by first or second class post to Wilsons Competitions LTD, 68 Dalrymple Street, Girvan, KA26 9BT by the Closing Date.
4. Free Entry Route
  If using the free entry route, you may only enter one competition per postcard entry. To enter via this method you must first create a free account on our website (if you do not already have one). Any ineligible entries will not be included as entrants to the competition. All postal entries must be received at our address (as set out in condition 3.3(b) above) by 5pm the day before the Closing Date. A random ticket number will be generated upon receipt of your postal entry and you will receive an email confirming receipt of your postal entry, the ticket number you have been allocated and to let you know that you have been entered into the competition. All competitions will have enough tickets reserved for at least 4 days to provide enough time for the postal entries to reach us. All postal entries are treated in the same way as entries using the paid route, and you will have an equal chance of winning the competition as those that enter via our website.
  1. There is no charge to register for use of the website.
  2. We will not accept:
    1. responsibility for competition entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any postal failure, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or
    2. proof of posting or transmission as proof of receipt of entry to the competition.
      1. By submitting a competition entry, you are agreeing to be bound by these Terms and conditions.
      2. Each competition entry (whether via the paid route or via the free postal entry route) will be allocated a number and the winner will be selected using the random number generator provided by www.random.org and this will be carried out live on our Facebook page.
      3. Competition entries made via the paid route are non-refundable, unless we cancel the applicable competition.
      4. We may by notice on our website extend the closing date and time if we reasonably think that circumstances require this.
      5. We reserve the right to cancel any of the competitions on the site, but shall ensure that refunds for all entry fees are paid to every entrant.
Eligibility
1. The competition is only open to residents in the UK, Channel Isles, Isle of Man and Republic of Ireland aged 18 years or over, except:
  1. employees of Wilsons Competitions LTD or its holding or subsidiary companies;
  2. employees of agents or suppliers of Wilsons Competitions LTD or its holding or subsidiary companies, who are professionally connected with the competition or its administration; or
  3. members of the immediate families or households of (a) and (b) above.
2. In entering the competition, you confirm that you are eligible to do so and eligible to claim any prize you may win. We may require you to provide proof that you are eligible to enter the competition or to claim your prize. You accept full responsibility for any entry to a competition outside of these eligibility requirements and shall ensure that you do not contravene any laws applicable outside of the UK. We do not accept any responsibility for any illegal competition entries.
3. We will not accept competition entries that are:
  1. automatically generated by computer;
  2. completed by third parties or in bulk;
  3. illegible, have been altered, reconstructed, forged or tampered with;
  4. late; or
  5. incomplete.
4. We accept no responsibility for entrants being unable to connect to our website to participate in any competition, due to any problem, technical or otherwise connected with your email or web connection. Proof of transmission is not proof of receipt.
5. The applicable competition page will set out the maximum number of entries per person for the competition. Entries on behalf of another person will not be accepted and joint submissions are not allowed.
6. We reserve all rights to disqualify you if your conduct is contrary to the spirit or intention of the prize competition.
7. Competition entries and money held in the entrants digital wallet cannot be returned.
The prize
1. Details and the number of prizes are as described on the applicable competition page on the website.
2. Prizes are subject to availability. We reserve the right to substitute the prize with a prize of equal or greater value.
3. The prize is not negotiable or transferable.
4. We reserve the right to substitute the prize for an alternative cash prize (“Cash Prize”) equal to the market value of the applicable prize offered by the Promoter including any original discounts on price. The Cash Prize value will be displayed on each applicable competition page or available on request. The prize may be substituted for a Cash Prize in the following circumstances:
  1. The applicable prize, or a reasonable alternative, becomes unavailable; or
  2. Other circumstances beyond our reasonable control which make it necessary to do so; or
  3. The winner opts for a Cash Prize instead of the applicable prize.
Winners
1. Our decision is final and no correspondence or discussion will be entered into.
2. We will contact the winner personally as soon as practicable after the Closing Date, using the email address provided with the competition entry. We will not amend any contact information once the competition entry form has been submitted.
3. We must either publish or make available information that indicates that a valid award took place. To comply with this obligation we will publish the surname and county of major prize winners and, if applicable, their winning entries on the website within 24 hours of the Closing Date.
4. If you object to any or all of your surname, county and winning entry being published or made available, please contact us. In such circumstances, we must still provide the information and winning entry to the Advertising Standards Authority on request.
Claiming the prize
1. Please allow 14 days for delivery of the prize.
2. Delivery will either be in person or via a courier or delivery service (as determined by us. The cost of delivery is free unless stated on the applicable competition page. A delivery charge may be charged for bespoke delivery requirements or for re-deliveries.
3. If the prize of the applicable competition is a motor vehicle then we will transfer the vehicle using the V5 for the vehicle. This must be completed before the vehicle is handed over and it is the responsibility of the winner to tax and insure the vehicle and we will not be responsible for the vehicle once it has been delivered.
4. We will make all reasonable efforts to contact the winner. If the winner cannot be contacted or is not available or has not claimed their prize within 14 days of the Closing Date, we reserve the right to offer the prize to the next eligible entrant selected from the correct entries that were received before the Closing Date using the same method as detailed in section 3.8.
5. We do not accept any responsibility if you are not able to take up the prize.
Limitation of liability
Insofar as is permitted by law, we, our agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of us, our agents or distributors or that of their employees. Your statutory rights are not affected.
Ownership of competition entries and intellectual property rights
1. All competition entries and any accompanying material submitted to us will become our property on receipt and will not be returned.
2. By submitting your competition entry and any accompanying material, you agree to:
  1. assign to us all your intellectual property rights with full title guarantee; and
  2. waive all moral rights,
    in and to your competition entry and otherwise arising in connection with your entry to which you may now or at any time in the future be entitled under the Copyright, Designs and Patents Act 1988 as amended from time to time and under all similar legislation from time to time in force anywhere in the world.
Data protection and publicity
1. We will only process your personal information as set out in its Privacy and Cookie Policy. See also condition 6.3 and condition 6.4, with regard to the announcement of winners.
2. If the applicable competition is offering a prize in partnership with a third party, then you agree to consent to your email address being shared with the third party. If you wish to unsubscribe from the third party’s email list then you may do so at any time by clicking on the unsubscribe button at the bottom of their email.
3. By giving us your details, you are agreeing that we may send you future promotional materials by email from time to time, such as our newsletter and details of special offers that may be of interest. You may unsubscribe at any time in accordance with our Privacy & Cookie Policy.
General
1. If there is any reason to believe that there has been a breach of these Terms and conditions, we may, at our sole discretion, reserve the right to exclude you from participating in the competition.
2. Events may occur that render the competition itself of the awarding of the prize impossible due to reasons beyond our reasonable control and accordingly we may at our absolute discretion vary, suspend, cancel or amend the competition and any entrant agrees that we shall have no liability as a result.
3. The draw will be carried out using Google Random Number Generator which will be streamed via Facebook Live.
4. The public can follow the draw on Facebook.
5. There will be no minimum required ticket sales. The prizes listed will be won regardless of ticket sales.
